1. Publisher of the service

Syniaps ("the Service") is published by Syniaps (website: www.syniaps.fr). Contact: [email protected]. By creating an account or using the Service, you accept these terms.

2. Purpose of the Service

The Service is an artificial intelligence assistant designed for businesses: it organizes your company's documents and knowledge, responds to your requests, and can connect, with your consent, to your cloud services (storage and email) to work on your data.

3. Account and security

The account is reserved for professional use. You are responsible for the accuracy of the information provided and for the confidentiality of your authentication credentials. Strong authentication is mandatory. You undertake to notify us without delay of any unauthorized use of your account.

4. Trial, subscription and termination

  • Signing up opens a free 30-day trial, with no commitment.
  • The Service is then billed by subscription according to the chosen plan (storage capacity, seats, options). The storage capacity of each plan includes the space occupied by the instance's system, whose size may change with use of the Service. Payment is processed by Stripe.
  • Termination takes effect at the end of the current paid period. The company's data is deleted within 30 days after the end of access. The copies held in encrypted backups then expire on their own, by rotation, within a maximum of six months.

5. Your content

You remain the owner of all content you entrust to the Service (documents, messages, synchronized data). You grant us only the technical license necessary to host, process and return this content as part of the operation of the Service. You warrant that you hold the necessary rights to the content you import or connect. The Service’s software and infrastructure remain the property of Syniaps or its suppliers: they are licensed to you for the duration of the subscription, and this license ends with it.

6. Personal data (data processing agreement)

The personal data you entrust to the Service is processed by Syniaps as a processor, in accordance with the Data Processing Agreement (DPA), which forms an integral part of these terms. You accept it together with these terms when you sign up; the date and version accepted are recorded. The processing of your account and billing data is described in the privacy policy.

7. Connected services

When you connect a third-party service (Google Drive, Gmail, Microsoft OneDrive/Outlook, Dropbox), you authorize the Service to access it within the limits described at the time of consent and in our privacy policy. The Service only performs actions on these services for the features you enable; it never deletes files in your cloud. You warrant that you are authorized to connect the account concerned.

8. Artificial intelligence assistant

The assistant's answers are generated automatically and may contain errors, omissions or approximations. They do not constitute legal, accounting or medical advice. You remain responsible for verifying the results before any important decision or communication.

8 bis. Choice of artificial intelligence provider

The assistant runs on a connection to an AI model provider that you set up in your connections. The default provider is Anthropic (Claude): with an API key, under its commercial terms, which exclude training its models on your data; with a personal Claude Pro or Max subscription, under its consumer terms, which allow such training while the account’s “Help improve Claude” setting is on. The Service also lets you connect, optionally and at your sole decision, an alternative provider: OpenAI (ChatGPT), Google (Gemini) or Moonshot AI (Kimi). Some are established outside the European Union, and some, depending on the type of account you connect, may use your exchanges to improve their products and models: the interface points out these characteristics when you connect, shows you where to turn that use off at the provider, and collects your explicit consent (checkbox) before any affected account is connected, default provider included.

By connecting an alternative provider, you acknowledge that the instructions and the content of your space used by the assistant are transmitted to it, as a sub-processor chosen by you, where applicable outside the European Union; you warrant, as data controller, that you have a legal basis and an appropriate transfer mechanism for that transmission; and you accept that Syniaps is not liable for the quality of the results, the availability or the processing practices of that provider, its obligation being limited to the secure transmission of your requests. For any individual account or personal subscription that allows it (Anthropic, OpenAI, Google), you undertake to turn off the use of your exchanges for the improvement of the provider’s products and models before connecting, or to use a company account; where the provider offers no such setting (Moonshot AI), you acknowledge that your content may be used to train its models unless you ask it otherwise. The terms, costs and availability of the chosen provider apply to you. You can switch back to the default provider at any time from your connections; the switch applies to later requests.

9. Acceptable use

You undertake in particular not to:

  • use the Service for unlawful purposes or to process unlawful content;
  • infringe the rights of third parties (intellectual property, privacy, trade secrets);
  • attempt to circumvent the security or isolation mechanisms of the Service;
  • resell the Service or give access to it to third parties outside your company without our agreement.

Failure to comply with these rules may result in suspension or termination of the account.

10. Availability and support

We make every effort to ensure high availability of the Service, without guaranteeing the absence of interruptions (maintenance, incidents, third-party dependencies). Support can be reached at [email protected].

11. Liability

To the extent permitted by law, Syniaps' liability in respect of the Service is limited to direct and foreseeable damages, and capped at the amounts paid by the customer over the last twelve months. Syniaps is not liable for decisions made on the basis of the assistant's answers, nor for unavailability attributable to connected third-party services.

12. Changes to these terms

We may update these terms; the date of the last update appears at the top of the page. In the event of a substantial change, workspace administrators are notified by email before it takes effect.

13. Governing law

These terms are governed by French law. Any dispute relating to the Service falls, failing an amicable settlement, under the jurisdiction of the competent courts.
